Kaiku Health is offered in conjunction with a healthcare provider (“Healthcare provider”) that offers healthcare services to You. Depending on the contractual framework between the Healthcare Provider and Kaiku Health Ltd, the data controller is either the Healthcare provider (in which case Kaiku Health Ltd acts as a data processor) or Kaiku Health Ltd. The data controller, and the contact information of the data controller and the assigned data protection officer, are presented to You upon registration.

Kaiku Health Ltd has established a Real World Data Partnership program, whose goal is to help researchers from life science companies and research institutions develop better cancer therapies by providing high-quality data about the outcomes and potential adverse effects of cancer treatments.

By participating in the Program, You can help create better treatments for patients around the world. The data you provide also allows our partners to introduce treatments to new patients faster, by helping them demonstrate the safety and effectiveness of the treatments. Kaiku Health Ltd does not disclose your name, social security number or contact details with Partners. Also, the contents of conversations with Your medical staff are not disclosed.

The partners of the Real World Data Partnership program (“Partners”) are life sciences, pharmaceutical and medical technology companies and institutions who have entered into a partnership agreement with Kaiku Health Ltd. For an up-to-date list of Partners your data would be shared with, you can contact our customer support at support@kaikuhealth.com.

Where Kaiku Health Ltd is not the data controller, the legality of the processing of personal data is based on your client- or patient relationship with the data controller, and the locally applicable laws laws and regulations imposed on the data controller as the administrator of client or patient register.

Receivers of personal data

You and the appropriate medical and administrative staff have access to Your personal data. Administrative staff only have access to Your personal information – they cannot access sent messages or forms or other medical data.

Kaiku health Ltd is responsible for technical support. Persons at Kaiku Health Ltd technical support have access to the personal and log information of the user, however not the patient information.

If you choose to participate in the Real World Data Partnership program, Kaiku Health Ltd may share the following data with current and future Partners of the Program: forms you fill in the Application,

By choosing to participate in the program, You give permission to Your Healthcare provider to transfer Your personal data and patient information related to your cancer and treatment to Kaiku Health Ltd for the purposes stated above.

Kaiku Health Ltd only discloses the data mentioned above to its Partners. In particular, Kaiku Health Ltd does not disclose your name, social security number or contact details with Partners. Also, the contents of conversations with Your medical staff are not disclosed.

Retention and erasure of personal information

The duration of personal information retention and the basis for it depends on locally (as determined by the place of registration of Your Healthcare provider) applicable legislation. More information is provided upon registration.

Disclosure of information to parties outside of the European Economic Area (EEA) and to other international organisations

If you consent to participate in the Real World Data Partnership, Your personal data may be disclosed to partners of the Real World Data Partnership that reside outside of the EEA only in compliance with applicable laws and regulations.

Rights of the data subject (You)

Right of access to personal information

You have the right to see all your personal data. You can access and view your personal data once logged into the Application.

Right to rectification

Right to erasure

Where Kaiku Health Ltd is not the data controller, according to EU general data protection regulation article 17 clause 3 b) You do not have the right to demand erasure of information, as the data controller has a legal obligation to comply with the regulations regarding retention of patient information.

Where Kaiku Health Ltd is the data controller, You are entitled to request the erasure of Your personal data processed in the context of the Real World Data Partnership program. However, Kaiku Health Ltd follows locally applicable laws and regulations concerning the retention of patient information. This may prevent erasure of some of Your personal data.

Right to restriction of processing

You have the right to request the restricted processing of Your data. The request should be addressed to the data controller (contact details are provided upon registration and in the Application). Your user account will be set as inactive for the duration of the restriction if You do not consent to the processing of information regarding You during the restriction period.

Right to data portability

Where Kaiku Health Ltd is not the data controller, the data controller is not obligated to provide the information in a specifically structured or generally used format as the use of the service is not based on Your consent.

Where Kaiku Health Ltd is the data controller, You have the right to demand the transfer of your data to another data controller and Kaiku Health Ltd must comply. Such requests should be sent to Kaiku Health Ltd.

Right to lodge a complaint with a supervisory authority

If You suspect that the terms outlined in this document are violated or that the terms are not legal, You have the right to lodge a complaint with a supervisory authority, especially in the EU member state in which You reside, work or where the claimed infringement took place. This will not impose restrictions on other due processes.

Right to retract consent

Where the legal basis of the data processing is Your consent, You have the right to retract the consent at any given time without any negative effect to Your medical treatment. You can do this in the Application after logging in. The retraction of the consent does not affect the legality of any/all information processed prior to the retraction.

Post-processing of data

Where Kaiku Health Ltd is not the data controller, it retains the right to generate anonymous statistical data from information inputs made within the Application for the purpose of developing and improving the Application. Examples of anonymous data generated include the overall number of messages and forms sent. Individual users cannot be identified from the anonymous data thusly generated.
